Book Description

About the Book
Three wars were destructive consequences of Kashmir imbroglio; continued hostilities fed malignancy of hatred in the sub-continent and the destruction of the nuclear war is being fed in the womb of the time. Four generations of J&K had been fed on political suffocation and economic subjugation; victims of continued oppression have been subjected to worst process of derailment of values.

Huge literature has been penned down by the lobbies of the two countries with intrinsic and extrinsic conflicts and contradictions. Competition in prosecution of the divide and rule policy on both sides has imposed uncertain and uneven division of that unique political geography which had for common interests assimilated all diversities in one cultural identity.

The leadership though offered sacrifices but all shades of it subordinated revolutionary manifesto to the intrigue against unity and collective honor of this nation. The duplicate role played by it has been qualified treacherous for the results it yielded. The real victims, the divided parts of J&K have suffered obscure confusion so could not expose the competition in intrigues against them. This book has dived deeper into the causes that led to the existing impasse: With research orientation and hair splitting of legal niceties the author finds that Indian bluffs, Pakistan blunders and treacheries of the local leadership have together complicated the destinies of several generations of J&K.

Seven Indian bluffs highlighted' include the claim of sovereignty attributed to, the then ruler who ruled State as licensee on behalf of the sovereign power, the Crown; that lease too terminated under Section (7) Indian Independence Act. Besides, the three main actors of the act of accession have been exposed as authors of loose fictional anecdote and Accession Deed also stands exposed. Thus, legally and factually the act of Accession is but a bluff hoodwinking all the concerned.

Pakistan has blundered fatally as it did not agitate the position of J&K Ruler; Amritsar Treaty had ceased on 15th August, 1947. Thus Pakistan miserably failed to expose the competence of the then Ruler to make any arrangement about the territories upon which his authority had ceased and the sovereignty had transferred from crown to the people.

Instead that country bungled about the sovereignty.

Other bluffs discussed include the attribution of the popularity to a party which had not dared to participate in the elections of JK Assembly held six months before the passing of Independence Act. The ministry sworn on 5th March 1948 was another deceptive and fraudulent bluff.

The appointment of the Regent by the abdicated Ruler is proved as the third bluff so his all actions stand challenged. All the elections conducted from 1950 have been discussed and shown convincingly to have been generally qualified as frauds so it is argued that under the mask of democratic hobnobbing the rulers in both the divided parts have been imposed.

Autonomy is another bluff; under that label this State is being ruled in the mess if' conflicting provisions of five constitutions and.' none of those five has any popular mandate from the State upon which those have been imposed.

After comparative study of the Instrument of Accession with Indian Constitution and provisions of Geol. Act, 1935 (which were applicable on 26th Octobe,1947), the epilogue to the book proves that the conditional and temporary but doubtful accession did ceased on 26th Jan, 1950. Similarly Pakistan blunders are so huge and gigantic which are only hinted along with the treacheries of the local leadership.
